Felony; spectators charged with misdemeanors gambling, weapons & drug charges 155 roosters

Sheriff's deputies in North Carolina arrested 73 people in what they called the largest cockfighting bust in county history.  An estimated 35-40 people fled into the nearby woods.

Deputies received a tip that led them to a large-scale cockfighting ring at 5254 Riverside Rd, Ramseur, N.C.  75 vehicles were also impounded as a result of the raid.  The 67.49 acre tract is about 2.3 miles off NC 42 South near the Coleridge community.  According to Randolph County Geographic Inquiry System the property is owned by Lewis Arthur & Rebecca L. Ritter.

"This is the largest in Randolph County that I know of and maybe in North Carolina," Sheriff Maynard Reid said. "This was a huge operation."

Deputies arrested 73 people and said many of them were illegal aliens.  For the illegal aliens, a detainee will be placed on them and they will be deported," Reid said.  Those in custody will be charged with a felony which can result in a 7-10 year sentence.

Animal control officers seized 130 roosters used in the fights.

"These birds can't be together," said Mimi Cooper, of Randolph Animal Control. "They'll kill each other. So they each have to be housed separately, and I don't know if they ever can be more than a fighting rooster."

Deputies said that this was no small-town bust. According to police, people came from as far away as Vermont and bet tens of thousands of dollars inside the ring.

At the time of the bust, police said $40,000 was on the line.  Everyone was charged $25 to enter and officers found evidence of betting, along with 2 firearms, cocaine & marijuana and an undetermined amount of money on the scene.

Cockfighting carries a felony charge and a maximum 10-year sentence in North Carolina, and officials said the gamblers in the ring were not amateurs.

Animal control officers at the scene found metal spikes that were attached to the chickens and found a pile of chickens that lost their lives while the gamblers hoped to get closer to the cash.

"There's dead chickens everywhere out the back door," Cooper said. "They just throw them out the back door when they get killed in the fight."

Randolph County deputies said they expect to be at the scene well into the night to oversee the towing of dozens of cars and the processing of 73 new felony charges.

The practice is illegal in 48 states. It is legal in New Mexico and Louisiana, and many immigrants from countries like Mexico and the Philippines continue their involvement in the sport after coming to the U.S.

Update 2/1/09:  4 people remain in custody.  The other 69 were released on bonds ranging from $1000 to $7,500 after being charged with 1 count of cockfighting and 1 count of cruelty to animals.

Among those charged was Barry Lewis Ritter, 33, of 5302 Riverside Rd.  Ritter's father owns the property were the raid was carried out.

The total of birds now confiscated including deceased roosters is 155.  The live birds are being held at an undisclosed location until local health officials figure out what to do with them.  Each bird is in a separate cage because they are so aggressive.  At this point they don't know if they will be held for evidence.  The health department has the birds as they assumed animal control duties in the county in 1996.

Officers are continuing to work with immigration officials to determine the residency status of those arrested.  73 people were arrested which includes 64 Hispanic males, 6 white males, 2 white females and 1 Hispanic female.  Ages range from 16 to 79; with addresses from throughout North Carolina as well as California, Florida, Georgia & Vermont.  2 teens were among those arrested and there were 6 children, ages 10-15 at the cockfight.

The following were charged with felony cockfighting and felony cruelty to animals. The listing is alphabetical:

Update 2/17/09:  All the birds were detroyed.  The concerns were how to house and feed the birds should they be kept as evidence - it would be at the taxpayers expense.  What if the birds carried some sort of avian disease?  Authorities needed to be concerned for the many poultry farms in the county.  In the raid, 130 birds were seized, another 25 were found dead.

A trial date has been set for February 24, 2009.

Update 2/24/09:  They didn’t have a bird in the fight, but 21 people who attended a cockfight raided by authorities Jan. 31 were ordered in Randolph District Court to abide by suspended sentences and pay fines.

In each of the cases, the defendants entered a guilty plea to a charge of attempted cockfighting, a misdemeanor.

Det. Lt. R.S. Stockner of the Randolph County Sheriff’s office told the court those entering pleas were “”spectators”” at illegal cockfights held in abandoned chicken houses uncovered near Coleridge.

During the raid, officers arrested 73 people, seized as many vehicles and took possession of 150 live birds, which were subsequently destroyed as a risk to public health.

Almost all of the 73 defendants were in court but, during a shortened court day, many of the cases were reset for an April 1 trial date, Stockner said.

Twelve people who came to court were detained by federal authorities, Stockner said, and six or seven other defendants may face preliminary hearings on felony charges.

Stockner said he was pleased with the outcome.  “When we get that many guilty pleas, it means if they get caught doing this again, they probably won’t get probation,” he said.

Noting that most of the defendants were Hispanic, he acknowledged that cockfighting was a part of that culture, “but they know that it’s wrong.”  He said authorities now believe there had been cockfights held at the Coleridge area location “at least two or three times before this.”

Those entering pleas were:

Rodolfo Garcia Alcala, Pedro Guapo Montenegro, Sadot Aviles Vargas, Zorobabell Baron, Juan Medina Guzman, Oscar Silvas, Federico Nava Morales, Armando Laredo Ventura, Cesar Petatan Mayo, Valdomero Tapia Vazquez, Ignacio Martinez, Agustin Serren Berrum, Mario Cisneros, Hernandez Feermin, Hector Bernal Gutierrez, Salinas Constantmo Perez, Octviano Bernardino Medel, Alexys Dominguez Santamaria, Luis Manuel Ruiz, Jose Feliciano Santamaria and Miguel Vazquez.

Update 4/1/09:  One lawyer said his client was simply “in the wrong place at the wrong time.”

That contention was echoed in guilty pleas entered in Randolph District Court by a dozen defendants, all acknowledging they were spectators Jan. 31 at illegal cockfights held in abandoned chicken houses near Coleridge.

Those entering pleas were handed suspended sentences, placed on unsupervised probation, ordered to pay fines and to do community service work. Each was allowed to plead to the misdemeanor charge of attempting cockfighting, reduced from initial felony charges. Money seized from them during the cockfight raid will go toward fines. None of the defendants had prior criminal records.

During an earlier court hearing in February, 21 other people who attended the cockfight received similar sentences.

Almost all of the original 73 defendants were in court.  Twelve defendants who appeared in February were detained by federal authorities.

Among those yet to come to trial are defendants who allegedly transported roosters to the fight or are accused of being directly involved in the cockfighting operation.

Assistant District Attorney Sonja Hole said that “seven or eight” of those type cases, involving several felony charges, will go to Superior Court for trial.

Those entering guilty pleas were: Roberto Sanchez Cabrera, Artoro Partillo Chairez, Julian Cortez-Rojas, Abel Martinez Espinoza, Eduardo Jaimes, Alfredo Guerrero Landeros, Olegario Mendoza Lopez, Angel Valles Miranda, Jorge Armando Ruiz, Baldemar Delgado Valdez, Sadot Aviles Vargas, and Bernardo Castanon Villanueva.
