Moorabool Shire Council lodged an application to have the Beremboke puppy farm in Anakie shut down.
While it had hoped to have an emergency hearing, it instead lodged an application with the Victorian Civil Administrative Tribunal for an interim enforcement order. This means council will have the authority to shut down the business if the owners are found to have breached.
Moorabool Shire spokesman David Jarwood said it hoped to have a hearing booked for this week at the latest.
Owners of the Beremboke puppy farm, Les and Melinda Paxton, have come under fire for the perceived treatment of animals on their property.
Photos from a secret raid of the property carried out by Animal Liberation Victoria showed puppies living in squalid conditions, with no food or water.
Angry community members and even Premier John Brumby have voiced their concern and called for the puppy farm to be closed down and the Paxton's charged with animal cruelty.
The RSPCA is now investigating the claims.
ALV campaign manager Debra Tranter said the Paxton's had removed the animals from the property.
"Animal Liberation Victoria believe the dogs are now at other puppy farms in Victoria and we hold little hope of them ever being rescued by government departments who have let them suffer and die over the past eight years," she said.
